Terms of service
Last updated 17 October 2026
These terms are the agreement between you and Hayden Killiby (ABN 94 858 034 943), who runs Inkloop. They cover your account, credits and plans, what you make, and the rules for using the service.
About these terms
Inkloop is an online studio for making images and animation with AI models. It's run by Hayden Killiby (ABN 94 858 034 943), a sole trader in New South Wales, Australia ("we" and "us"). By creating an account or using Inkloop you agree to these terms, our Privacy policy and our Acceptable use policy.
You must be at least 18, or the age of legal majority where you live if that's higher. If you use Inkloop for a business or a channel, you confirm you can accept these terms for it.
Your account
You sign in with a link we email you, so anyone who can read your inbox can get into your account. Keep your email secure, and tell us straight away if you think someone else has used your account.
An account is for one person. Don't share or sell it, and don't open extra accounts to get more credits or get around limits.
We can suspend or close an account that breaks these terms or the Acceptable use policy, is used for fraud, or has a payment disputed. Where it's reasonable, we'll tell you why and give you a chance to respond.
Credits
- Generating costs credits. The cost is shown on the Generate button before you start, and depends on the model, settings and length you choose.
- Credits are taken when you submit a generation. If it fails, is blocked by a content filter, or is cancelled before it runs, the credits go back to your balance automatically.
- Plan credits are added at the start of each billing period and reset to your plan's allowance, so unused plan credits don't carry over. On a yearly plan they're added every month.
- Top-up credits don't expire while your account is open. Plan credits are used first, then top-ups.
- Credits aren't money. They have no cash value and can't be transferred or exchanged. If your account is closed, unused credits are lost, except where the law says otherwise.
- We may change how many credits a model costs, and add or remove models. The price shown before you generate is the price you pay.
- To prevent fraud, new accounts can buy only a limited number of credit packs at first.
Plans, payments and cancelling
Prices are in US dollars, and payments are processed by Stripe. Your bank may add a currency conversion fee. If we have to charge tax, it's shown at checkout.
Plans renew automatically every month or year until you cancel. You can cancel any time from Billing in your account. Your plan and its credits stay active until the end of the period you've paid for.
If you switch plans, the change applies straight away and Stripe charges or credits the difference. When an upgrade is paid, your plan credits reset to the new plan's allowance.
We'll email you at least 30 days before a price change applies to your plan. If you don't want the new price, cancel before your next renewal.
Refunds and disputes
Our services come with guarantees that can't be excluded under the Australian Consumer Law. If something has gone wrong with a purchase, email hadeenkillovic@gmail.com and we'll sort it out with you, including a refund where the law requires one or where we think it's fair.
If we refund a payment, the credits it added are removed in proportion to the refund.
If you dispute a payment with your bank instead of contacting us, we pause the account while the dispute is open, remove the unspent credits that payment added, and cancel any subscription. If the dispute is resolved in our favour, those credits are returned.
What you make
You keep whatever rights you have in what you upload. You own what you generate, to the extent the law allows, and you can use it commercially, including on monetised channels. Neither we nor Higgsfield, our model provider, claim ownership of your outputs.
AI outputs may not be protected by copyright in every country, and other people can get similar results from similar prompts. We can't promise that your outputs are unique, or that you can stop others using something similar.
You're responsible for how you use outputs. That includes checking they don't infringe anyone's rights (characters, logos, brands, a person's likeness), and making any disclosures the law or a platform requires: YouTube, for example, asks creators to label realistic altered or synthetic content. Don't remove watermarks or provenance information that a model adds.
Your content and our licence
To run Inkloop we need your permission to store, copy, process and display your prompts, uploads and outputs, and to send them to the AI model providers that make your generations. You give us that permission for as long as the content is in your account, and afterwards for as long as backups and the law require.
Generation runs on Higgsfield. Its Terms of Use let it use content processed through its service, including prompts, uploads and outputs, to train and improve its AI models. Don't upload anything you aren't comfortable with being used that way.
If you publish to Community, you also let us show that output, with its prompt and settings, on Inkloop and in links to it, until you unpublish it.
Acceptable use
Follow the Acceptable use policy. If you don't, we can block a generation, remove published work, or suspend or close your account.
The service
Inkloop depends on third-party AI models and services. Results can be unexpected, inaccurate or different each time, models can change or be withdrawn, and generation can be paused for maintenance or while a provider is unavailable. While generation is paused, no credits are taken.
We work to keep Inkloop running and your work safe, but we can't promise it will always be available or free of errors. Download anything you can't afford to lose.
Liability
Nothing in these terms excludes rights you have under the Australian Consumer Law or any other law that can't be excluded.
Otherwise, to the extent the law allows, we aren't liable for indirect or consequential loss, such as lost revenue, views or data, and our total liability to you is limited to what you paid us in the 12 months before the claim. Where the Australian Consumer Law lets us limit our liability for failing to meet a consumer guarantee, our liability is limited to supplying the service again or paying the cost of having it supplied again.
You're responsible for claims that arise from content you upload or publish, or from your breach of these terms.
Closing your account
You can stop using Inkloop at any time. To close your account and delete your data, email hadeenkillovic@gmail.com from your account's address. Cancel any plan first so you aren't charged again.
We can close accounts as described above. If we stop offering Inkloop, we'll give you at least 30 days' notice and refund the unused part of any yearly plan.
Changes to these terms
We may update these terms. For significant changes we'll email you or show a notice in Inkloop at least 14 days before they apply. If you keep using Inkloop after that, the new terms apply.
Law and contact
These terms are governed by the law of New South Wales, Australia. Questions or complaints: hadeenkillovic@gmail.com.
